Emerson alleges that during BUD/S an instructor kicked a trainee (whom he identifies as “Garcia”) hard enough to break his ankle, ending the trainee’s course. He also describes later being asked repeatedly to identify witnesses and refusing to come forward at the time, adding that he later encountered the instructor and says the instructor told him he “almost got cam” for it.
