"We are approaching the 1-year anniversary of Charlie's assassination, which is just mind-boggling on its face. 10 months have passed since the defendant's arrest, and the 5-day preliminary hearing has now concluded. The victim of a crime has the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant. We respectfully urge this court to issue its probable cause determination no later than September 1st, 2026."
The Kirk family's legal representative filed an urgent motion requesting Judge Graf issue a probable cause determination by September 1st, warning that further delays could push resolution past the one-year anniversary of the assassination. The filing cited Utah law guaranteeing crime victims the right to speedy resolution, as the case has already experienced a two-month delay from its original May hearing date.
